“we” and “us” refers to Avanti Jewellers of Ashbourne.

“website” or “site” refers to the website: www.avantijewellers.co.uk

“you” refers to the person using the website, whether as an unregistered guest or as a registered user.

Services Terms and Conditions

 

1.       Repairs Terms

 

1a. Consultation: Our front of house team will assess your item in the first instance. They will make a note of the metal (if possible), quantity and colour of any gemstones and take a sensitive scale reading of the weight.

Initial assessment will be made of the repairs requested, as well as any other damage, wear or identifying marks that may need to be noted before work is undertaken.

 

i)                              You will be given a quote for the cost of the repair at this stage. Please bear in mind this quote is based on the repair identified and requested. If any further issues arise when the item is assessed by the specialists, we will discuss these with you before proceeding any further. You will have the right to refuse additional work.

ii)              If you wish to proceed with the repair, your details and those of the item will be recorded on our repairs database and you will be given a receipt for your item. You must keep your receipt safe as it contains the information allowing you and us to identify your repair during and after completion.

iii)            Whilst we do our best to give you an accurate quote at the initial consultation, each jewellery piece is unique and some items will require an estimate. Estimates are not always final, but we always try our best to keep the final cost on or below the price estimated.

1b. Detailed assessment: Our workshop team will carry out a detailed assessment of the repair before any work is commenced.

i)               Any issues note noted on the initial assessment of the repair will be identified. If these issues are likely to affect the cost of your repair quote, you will be contacted before any work is carried out. You will have the opportunity to refuse any revised quote.

1c. Liability

i)               All repair work is carried out at the customer’s own risk. If an item is damaged during an attempted repair, where all reasonable care and attention has been given to the item and its repair, Avanti can not accept responsibility for this, although we will work with you to come to a resolution as much as possible.

ii)              Repairing jewellery set with gemstones is not without risk. While Avanti takes the greatest of care and precautions, it is possible for gemstones to become damaged. In some instances, stone settings are holding an otherwise broken gemstone together and this may only become apparent when repairs commence. Avanti does not accept liability for such breakages, though we will try to identify such issues during the assessment stages.

iii)            It is the duty of the customer to inspect their items upon collection to ensure they are satisfied with the work carried out and to report any issues.

 

 

1d. Commencement of work

i)               Once a quote has been accepted we will commence work on your repair at the earliest possibility. This will begin by ordering in any materials necessary to create it. If an order is cancelled after this point, you may be liable to cover any costs for such materials.

ii)              Avanti reserves the right to photograph, film and publish images/video of any work being carried out in our workshops or by our workshop staff. You are entitled to request that video and/or photographs are not taken for any reason.

iii)            Avanti may need to send your items away for specialist work (such as hallmarking).

 

 

1e. Changing Your Mind: We understand that jewellery can be sentimental, and that customers may wish to reconsider the decision to have any work carried out on it.

i)               If you change your mind, you must inform us at the earliest opportunity.

ii)              If the repair has already been started or completed, you will be liable to cover any costs for work which has been carried out.

iii)            If repair work has begun at the point of cancellation, work will stop immediately and the items will be given back to you at whatever stage this occurs. Avanti is not obligated to remedy such items to their previous condition/state.


 

1f. Collecting your repair

i)               To collect your items, you will need to bring at least one form of photo ID which matches the name on the order. Your receipt will help our team to locate your repair. For security reasons, without a form of ID, Avanti may refuse to hand over goods if a valid ID cannot be presented.

ii)              If you wish for a friend or relative to collect your repair for you, this should requested in writing via email (info@avantijewellers.co.uk) with your name, order details and the full name of the person you have nominated to collect. The person collecting must then bring a form of photo ID as outlined above.

iii)            It is the duty of the customer to inspect their repair thoroughly upon receipt. If you suspect there may be a fault or problem, this should be reported to us within 48 hours of the item being collected.

 

1g. Warranties

i)                Jewellery: We offer a 12 month warranty on the work carried out on your jewellery as per the quotation. In the event of a fault covered by the warranty, we will, without cost, repair or replace, at our discretion, any spare part and/or rectify the faulty repair as identified by our Goldsmiths. This warranty does not cover normal wear and tear or damage caused by accidents or negligence. This warranty will be invalid if any subsequent work is carried out on your jewellery by a person who is not authorised to do so by us. This does not affect your statutory rights.

ii)             Watches: We offer a 24 month warranty on the work carried out on your watch which protects against faults on the work which has been carried out. If such an issue is found to be covered by the warranty, we will, without cost, repair or replace, at our discretion, any spare part and/or rectify the faulty repair as identified by our Goldsmiths. This warranty does not cover normal wear and tear (such as batteries, leather straps etc) or damage caused by accidents or negligence. This warranty will be invalid if any work is carried out on your watch by a person who is not authorised to do so by us. This does not affect your statutory rights.

2.        Bespoke Jewellery Designs and HingeFit Rings

 

2a. Consultation: Our front of house team will assess your request in the first instance.

i)                              After a discussion about what you would like / require, you will be given a quote for the cost of the work at this stage. You will have the right to refuse the quotation and discuss alternative approached to lower costs.

ii)                           If your idea for bespoke piece has been created ‘from imagination’ you will be shown a mock-up of what to expect your bespoke order to look like upon completion. This may not always be necessary (for example if you are ordering a design similar to something which is readily available). It is the duty of the customer to raise any concerns or request changes at this stage. Any change requests made may affect the quotation.

iii)                        If a Computer Aided Design (CAD) is needed, we will require a £100.00 pre-deposit which will be deducted from any final payment.

iv)            We will give you an estimated completion date for your order, taking into account any desired completion date that you provide when the order is placed, though this cannot always be guaranteed due to reliance on third parties.

 

v)              If you wish to proceed with the bespoke service, a non-refundable deposit will be taken (in addition to the pre-deposit mentioned above) and your details and those of your order will be recorded on our database. Additionally, you will be given a receipt which you must keep safe, as it contains the information allowing you and us to identify your bespoke order during and after completion.

 

vi)            Whilst we do our best to give you an accurate quote at the initial consultation, each jewellery piece is unique and some items will require an estimate. Estimates are not always final, but we always try our best to keep the final cost on or below the price estimated.

 

vii)           All jewellery designs are the intellectual property of Avanti, both before, during and after the bespoke order process has been carried out. Taking our designs to another retailer or manufacturer for any reason can be considered to be copyright infringement and you may face legal action.

2c. Liability

i)               Remodelling jewellery set with gemstones is not without risk. While Avanti takes the greatest of care and precautions, it is possible for gemstones to become damaged. In some instances, stone settings are holding an otherwise broken gemstone together and this may only become apparent when work commences.

ii)              Avanti does not accept liability for such breakages, though we will try to identify such issues during the assessment stages and if needed we will find a replacement which is as close to the original as possible. In rare cases this can impact the final cost of your bespoke order.

2d. Bespoke order cancellations

i)               If you change your mind, you must inform us at the earliest opportunity.

ii)              If the order has already been started or completed, you will be liable to cover any costs for materials and any work which has been carried out.

iii)            If repair work has begun at the point of cancellation, work will stop immediately. Avanti reserves the right to charge you for any work that has been carried out up to this point.

i)               In cases where Avanti is using customer-provided materials or repurposing pre-existing jewellery, Avanti workshop staff will be required to melt or otherwise break down such items in order to craft the bespoke order. If such an order is cancelled, these materials will be returned to you, however Avanti is not obligated to remedy any items or materials to a previous condition/state which they may have been prior to any work being carried out.


2e. Collecting your order

i)               To collect your items, you will need to bring the receipt which was given at the time of placing the order. Your receipt will help our team to locate your order. For security reasons, Avanti reserves the right to request a form of photo ID, so it is advised that you bring one. Avanti may refuse to hand over goods if a valid ID cannot be presented.

ii)              It is expected that customers collect their bespoke orders within 4 weeks of the order being ready. Customers should make Avanti aware if they do not expect to be able to meet this requirement.

iii)            Once a bespoke order is ready for collection, Avanti will try to make contact with you via phone, email and voicemail. If a bespoke order has not been collected within 6 months and no contact has been made, Avanti staff reserve the right to do with your order as they sees fit. In such circumstances, you will lose your deposit.

iv)            If you wish for a friend or relative to collect your order for you, this should requested in writing via email (info@avantijewellers.co.uk) with your name, order details and the full name of the person you have nominated to collect. The person collecting must then bring a form of photo ID as outlined above.

v)              It is the duty of the customer to inspect their order thoroughly upon receipt. In the case of HingeFit rings, you will also be shown how to operate the mechanism within the ring at this stage. If you suspect there may be a fault or problem with your bespoke order, this should be reported to us within 48 hours of the item being collected.

vi)            Any outstanding balance must be settled at the point of collection.

3. Selling your items to Avanti


At Avanti Jewellers, we can assist you with selling your unwanted gold, silver, jewellery and watches.

3a. Selling jewellery or ‘scrap’ metals

i)                              You must present a valid form of photo ID if you wish to sell an item of any kind to Avanti Jewellers.

ii)                           Avanti has an in-house system which calculates how much your items are worth. Due to high levels of fluctuation, this value is not connected or influenced by current ‘market values’ for such metals. You are not obligated to sell any of your items if you are unsatisfied with the amount offered.

iii)                        Avanti may need to perform tests to authenticate the metals being offered for sale.

iv)                        If items of jewellery are intact, Avanti reserves the right to resell items whole in it’s ‘pre-owned’ section in store and online at any value which it deems fit.

v)                           Once an item has been sold, Avanti is under no obligation to return such items should you change your mind. If you do change your mind we will endeavour to work with you on returning your items but please be aware, there is no official ‘cooling off’ period and it can often be that items are melted down very soon after they are received.

vi)                        Avanti reserves the right to decline any scrap sale without reason.

 

3b. Selling used watches to Avanti

i)                              You can enquire about selling a used timepiece by calling us directly. Due to limited space in-store, Avanti will only purchase timepieces from reputable watch brands of a certain value. Common brands we accept include (but are not limited to) Rolex, TUDOR, Omega, Cartier, Breitling and TAG Heuer.

ii)                           Watches will need to be examined in person before any offer can be made. The reasoning for a price offered will depend on a variety of factors, including (but not limited to) the age and condition of the watch, any accompanying items such as the box, warranty or paperwork, proofs of servicing and general market demand for the item.

iii)                        Avanti reserves the right to decline any used watch sale without reason.

 

3c. Avanti ‘Sale or Return’ service

Our sale or return process allows you to leave your jewellery or watches at Avanti for us to showcase in our popular pre-owned jewellery display and list on our website to sell for you.

i)               To give you an estimated sale value for your jewellery, we ask for the item to be left with us for assessment. This includes checking over stones and the overall condition of the piece.

ii)              Not every piece of jewellery is appropriate for sale or return with us. On these occasions we ask the customer to collect their items. There is no charge for this.

iii)             If we think your piece of jewellery may sell, we will email you the figure we would offer. This figure is the full amount you will receive from Avanti.

iv)             Avanti sells your item at a second-hand retail appropriate figure. This higher figure allows us to offer discount without affecting the amount you will receive, and takes into consideration the tax element of the sale.

v)              Before we sell your item, it goes to our workshop for a clean and polish, for it to be in the most saleable condition. There is a £20 standard charge for this service, which is only payable if the item doesn't sell. If we feel more work is required to reach this condition we will inform you to discuss costs.

vi)             If you would like your item listed on our website, there is a £10 charge, which is only payable if the item doesn't sell.

vii)            We will display your piece within our pre-owned jewellery collection for a maximum of 6 months. If we feel the item needs to be reduced in price we will always contact, you prior to doing so.

viii)          If your item sells in the shop, Avanti must wait 4 weeks before contacting you and requesting your bank details. This allows us to use our standard returns policy on pre-owned jewellery.

4.  Disputes


Any disputes not resolved by normal complaints procedure will be resolved exclusively in the courts of England under English law. These conditions do not affect your statutory rights.

 

 

5.  Our site changes regularly

We aim to update our site regularly, and may change the content at any time. If the need arises, we may suspend access to our site, or close it indefinitely. Any of the material on our site may be out of date at any given time, and we are under no obligation to update such material.

 

6. Our liability

 

The material displayed on our site is provided without any guarantees, conditions or warranties as to its accuracy. To the extent permitted by law, we, and third parties connected to us hereby expressly exclude:

 

i)                              All conditions, warranties and other terms which might otherwise be implied by statute, common law or the law of equity.

 

ii)                           Any liability for any direct, indirect or consequential loss or damage incurred by any user in connection with our site or in connection with the use, inability to use, or results of the use of our site, any websites linked to it and any materials posted on it, including, without limitation any liability for:

-              loss of income or revenue;

-              loss of business;

-              loss of profits or contracts;

-              loss of anticipated savings;

-              loss of data;

-              loss of goodwill;

-              wasted management or office time; and

for any other loss or damage of any kind, however arising and whether caused by tort (including negligence), breach of contract or otherwise, even if foreseeable, provided that this condition shall not prevent claims for loss of or damage to your tangible property or any other claims for direct financial loss that are not excluded by any of the categories set out above.

This does not affect our liability for death or personal injury arising from our negligence, nor our liability for fraudulent misrepresentation or misrepresentation as to a fundamental matter, nor any other liability which cannot be excluded or limited under applicable law.

 

 

 

7.  Jurisdiction and applicable law

 

The English courts will have non-exclusive jurisdiction over any claim arising from, or related to, a visit to our site.

These terms of use and any dispute or claim arising out of or in connection with them or their subject matter or formation (including non-contractual disputes or claims) shall be governed by and construed in accordance with the law of England and Wales.

 

8.  Discounts and Promotions

 

Discount codes / vouchers not valid against the cost of any of our Avanti Services unless otherwise stated. 

Avanti reserves the right to refuse any discount without reason.
